Terms of Service

We are Artur Kozhushnyi ("Company", "we", "us", "our"), a company registered in Poland at Kielce, Świętokrzyskie 25-001. We operate the website statiso.io (the "Site") as well as any other related products and services that refer or link to these legal terms (collectively, the "Services").

Statiso is a web platform that provides online quizzes, psychological assessments, and surveys. You can contact us by email at [email protected].

These Legal Terms constitute a legally binding agreement between you and Artur Kozhushnyi concerning your access to and use of the Services. By accessing the Services, you have read, understood, and agreed to be bound by all of these Legal Terms. IF YOU DO NOT AGREE WITH ALL OF THESE LEGAL TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICES AND YOU MUST DISCONTINUE USE IMMEDIATELY.

The Services are intended for users who are at least 18 years old. Persons under the age of 18 are not permitted to use or register for the Services.

1. OUR SERVICES

The information provided when using the Services is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation. Those who access the Services from other locations do so on their own initiative and are solely responsible for compliance with local laws.

The Services are not tailored to comply with industry-specific regulations (HIPAA, FISMA, etc.). You may not use the Services in a way that would violate the Gramm-Leach-Bliley Act (GLBA).

Survey analytics. When you participate in a survey or quiz while signed in, a snapshot of your demographic profile (as you have voluntarily entered it) is associated with your response. Aggregated and anonymized breakdowns of this data — including demographic, geographic, device, and timing information — are made available to the creator of that survey for analytical purposes. Your name, email address, and account identity are never exposed to survey creators. Anonymous participation (without signing in) is always available and records no profile data.

2. INTELLECTUAL PROPERTY RIGHTS

Our intellectual property

We are the owner or licensee of all intellectual property rights in our Services, including all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics (collectively, the "Content"), as well as the trademarks, service marks, and logos ("Marks"). Our Content and Marks are protected by copyright and trademark laws worldwide.

Subject to your compliance with these Legal Terms, we grant you a non-exclusive, non-transferable, revocable license to access the Services for your personal, non-commercial use only. Except as expressly set out herein, no part of the Services, Content, or Marks may be copied, reproduced, published, distributed, sold, or otherwise exploited for any commercial purpose without our express prior written permission.

Your submissions and contributions

Submissions: By sending us any question, comment, suggestion, idea, or feedback about the Services ("Submissions"), you agree to assign to us all intellectual property rights in such Submission, and we may use it for any lawful purpose without acknowledgment or compensation.

Contributions: The Services may invite you to participate in forums or other functionality where you may create, submit, or broadcast content ("Contributions"). By posting Contributions, you grant us an unrestricted, unlimited, irrevocable, perpetual, worldwide license to use, copy, reproduce, distribute, publish, translate, and exploit such Contributions for any purpose. We may remove or edit any Contributions at any time without notice if we consider them harmful or in breach of these Legal Terms.

3. USER REPRESENTATIONS

By using the Services, you represent and warrant that:

1. All registration information you submit will be true, accurate, current, and complete.
2. You will maintain the accuracy of such information and promptly update it as necessary.
3. You have the legal capacity and agree to comply with these Legal Terms.
4. You are not a minor in the jurisdiction in which you reside.
5. You will not access the Services through automated or non-human means.
6. You will not use the Services for any illegal or unauthorized purpose.
7. Your use of the Services will not violate any applicable law or regulation.

4. USER REGISTRATION

You may be required to register to use the Services. Registration via email and password requires verification of your email address through a one-time code sent to you. Alternatively, you may register using your existing Google, GitHub, or Telegram account. You agree to keep your password confidential and will be responsible for all use of your account and password. We reserve the right to remove, reclaim, or change a username if we determine, in our sole discretion, that such username is inappropriate, obscene, or otherwise objectionable.

5. PURCHASES AND PAYMENT

We accept the following forms of payment: Visa, Mastercard, American Express, Discover, PayPal.

You agree to provide current, complete, and accurate purchase and account information for all purchases. All payments shall be in US dollars. We reserve the right to correct any errors in pricing and to refuse any order placed through the Services.

6. SUBSCRIPTIONS

Billing and Renewal

Your subscription will continue and automatically renew unless canceled. You consent to our charging your payment method on a recurring basis until you cancel.

Free Trial

We offer a 14-day free trial to new users. The account will not be charged until upgraded to a paid version at the end of the free trial.

Cancellation

All purchases are non-refundable. You can cancel your subscription at any time by logging into your account. Your cancellation will take effect at the end of the current paid term. If you have questions or are unsatisfied, please email us at [email protected].

7. PROHIBITED ACTIVITIES

You may not access or use the Services for any purpose other than that for which we make them available. As a user, you agree not to:

• Systematically retrieve data to create a collection, compilation, or database without written permission.
• Trick, defraud, or mislead us and other users, especially to learn sensitive account information.
• Circumvent, disable, or otherwise interfere with security-related features of the Services.
• Use any information obtained to harass, abuse, or harm another person.
• Make improper use of our support services or submit false reports.
• Use the Services in a manner inconsistent with any applicable laws or regulations.
• Upload or transmit viruses, Trojan horses, or other harmful material.
• Engage in any automated use of the system (data mining, bots, scrapers).
• Attempt to impersonate another user or person.
• Interfere with, disrupt, or create an undue burden on the Services.
• Decipher, decompile, disassemble, or reverse engineer any part of the Services.
• Use the Services to advertise or offer to sell goods and services.
• Sell or otherwise transfer your profile.

8. USER GENERATED CONTRIBUTIONS

The Services may provide you with the opportunity to create, submit, or broadcast content ("Contributions"). When you create or make available any Contributions, you represent and warrant that your Contributions do not infringe any third-party rights, are not false or misleading, are not obscene or objectionable, and comply with all applicable laws.

9. CONTRIBUTION LICENSE

By posting Contributions, you grant us an unrestricted, unlimited, irrevocable, perpetual, non-exclusive, transferable, royalty-free, fully-paid, worldwide license to host, use, copy, reproduce, distribute, publish, broadcast, translate, and exploit such Contributions for any purpose. You retain full ownership of your Contributions and any associated intellectual property rights, but waive all moral rights therein.

10. MOBILE APPLICATION LICENSE

If you access the Services via a mobile application, we grant you a revocable, non-exclusive, non-transferable, limited right to install and use the App on devices you own or control, strictly in accordance with these Legal Terms. You shall not decompile, reverse engineer, or create derivative works from the App; use the App for revenue-generating endeavors; or make the App available over a network permitting access by multiple users simultaneously.

11. SOCIAL MEDIA

As part of the Services, you may link your account with third-party service providers (e.g. Google, GitHub, Telegram). By doing so, you grant us access to certain profile information from those providers as described in our Privacy Policy. We may access, store, and make available any content you have provided and stored in your Third-Party Account. You can deactivate these connections at any time through your account settings.

12. THIRD-PARTY WEBSITES AND CONTENT

The Services may contain links to third-party websites ("Third-Party Websites") and content ("Third-Party Content"). Such websites and content are not investigated or monitored by us, and we are not responsible for their accuracy, appropriateness, or content. Inclusion of any link does not imply our approval or endorsement. If you access Third-Party Websites, you do so at your own risk and these Legal Terms no longer govern.

13. ADVERTISERS

We allow advertisers to display their advertisements in certain areas of the Services. We simply provide the space to place such advertisements and have no other relationship with advertisers.

14. SERVICES MANAGEMENT

We reserve the right to: (1) monitor the Services for violations of these Legal Terms; (2) take appropriate legal action against anyone who violates the law or these Legal Terms; (3) refuse, restrict access to, or disable any of your Contributions; (4) remove files and content that are excessive in size or burdensome to our systems; and (5) otherwise manage the Services to protect our rights and property.

15. PRIVACY POLICY

We care about data privacy and security. Please review our Privacy Policy. By using the Services, you agree to be bound by our Privacy Policy, which is incorporated into these Legal Terms. The Services are hosted in Germany. If you access the Services from any other region, you expressly consent to have your data transferred to and processed in Germany.

16. COPYRIGHT INFRINGEMENTS

We respect the intellectual property rights of others. If you believe that any material available through the Services infringes upon any copyright you own or control, please notify us immediately at [email protected].

17. TERM AND TERMINATION

These Legal Terms shall remain in full force and effect while you use the Services. WE RESERVE THE RIGHT TO, IN OUR SOLE DISCRETION AND WITHOUT NOTICE OR LIABILITY, DENY ACCESS TO AND USE OF THE SERVICES TO ANY PERSON FOR ANY REASON, INCLUDING BREACH OF ANY REPRESENTATION, WARRANTY, OR COVENANT CONTAINED IN THESE LEGAL TERMS. We may terminate your account and any content at any time, without warning.

If we terminate or suspend your account for any reason, you are prohibited from registering and creating a new account under any name.

18. MODIFICATIONS AND INTERRUPTIONS

We reserve the right to change, modify, or remove the contents of the Services at any time at our sole discretion without notice. We cannot guarantee the Services will be available at all times. We will not be liable to you for any modification, suspension, or discontinuance of the Services.

19. GOVERNING LAW

These Legal Terms are governed by and interpreted following the laws of Poland. If your habitual residence is in the EU and you are a consumer, you additionally possess the protection provided by the obligatory provisions of the law in your country of residence. You may make a claim in Poland or in the EU country in which you reside.

20. DISPUTE RESOLUTION

Informal Negotiations

The parties agree to first attempt to negotiate any Dispute informally for at least thirty (30) days before initiating arbitration.

Binding Arbitration

Any dispute shall be determined by one arbitrator chosen in accordance with the Arbitration and Internal Rules of the European Court of Arbitration. The seat of arbitration shall be Warsaw, Poland. The language of proceedings shall be English or Polish.

Restrictions

Any arbitration shall be limited to the Dispute between the parties individually. No arbitration shall be joined with any other proceeding, and there is no right to arbitrate on a class-action basis.

21. CORRECTIONS

There may be information on the Services that contains typographical errors, inaccuracies, or omissions. We reserve the right to correct any errors and to change or update information at any time, without prior notice.

22. DISCLAIMER

THE SERVICES ARE PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE MAKE NO WARRANTIES ABOUT THE ACCURACY OR COMPLETENESS OF THE SERVICES' CONTENT AND ASSUME NO LIABILITY FOR ERRORS, PERSONAL INJURY, UNAUTHORIZED ACCESS TO OUR SERVERS, INTERRUPTION OF TRANSMISSION, OR BUGS TRANSMITTED THROUGH THE SERVICES.

23. LIMITATIONS OF LIABILITY

IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF THE SERVICES. OUR LIABILITY TO YOU SHALL AT ALL TIMES BE LIMITED TO THE LESSER OF THE AMOUNT PAID BY YOU TO US DURING THE SIX (6) MONTH PERIOD PRIOR TO ANY CAUSE OF ACTION OR $50.00 USD.

24. INDEMNIFICATION

You agree to defend, indemnify, and hold us harmless from and against any loss, damage, liability, claim, or demand — including reasonable attorneys' fees — made by any third party due to or arising out of: (1) your Contributions; (2) use of the Services; (3) breach of these Legal Terms; (4) any breach of your representations and warranties; (5) your violation of the rights of a third party; or (6) any harmful act toward any other user of the Services.

25. USER DATA

We will maintain certain data that you transmit to the Services for the purpose of managing the Services. Although we perform regular routine backups of data, you are solely responsible for all data that you transmit or that relates to any activity you have undertaken using the Services. We shall have no liability to you for any loss or corruption of any such data.

Account deletion. You may request deletion of your account at any time through your account settings. Upon deletion, your profile information, email address, display name, linked social accounts, and all other directly identifying data are permanently removed from our active systems. Anonymized statistical participation records — entries from which all personal identifiers have been irreversibly removed — may be retained to preserve the statistical integrity of aggregate survey results. These records cannot be linked back to you.

Uploaded content. You may upload images (such as a profile avatar) to the Services. Uploaded files are stored on our servers in Germany. By uploading content, you confirm that you have the right to do so and that the content does not violate any third-party rights or applicable law. Upon account deletion, your uploaded files are removed from our servers.

26. ELECTRONIC COMMUNICATIONS, TRANSACTIONS, AND SIGNATURES

Visiting the Services, sending us emails, and completing online forms constitute electronic communications. You consent to receive electronic communications and agree that all agreements, notices, and other communications we provide to you electronically satisfy any legal requirement that such communication be in writing.

27. CALIFORNIA USERS AND RESIDENTS

If any complaint with us is not satisfactorily resolved, you can contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, California 95834 or by telephone at (800) 952-5210 or (916) 445-1254.

28. MISCELLANEOUS

These Legal Terms and any policies posted by us on the Services constitute the entire agreement between you and us. Our failure to exercise or enforce any right or provision shall not operate as a waiver of such right. If any provision of these Legal Terms is determined to be unlawful or unenforceable, it is deemed severable and does not affect the validity of the remaining provisions. There is no joint venture, partnership, employment, or agency relationship created between you and us as a result of these Legal Terms.

29. MEDICAL AND PSYCHOLOGICAL DISCLAIMER

30. ATTRIBUTION

Certain assessments and tools available on the Services may utilize data, structures, or scoring mechanisms based on resources from the Open-Source Psychometrics Project and the International Personality Item Pool (IPIP). These materials are used in accordance with their respective public domain or open-source licenses.
